Jack Alexander Lusty: Albany man accused of ‘sustained’ and ‘prolonged’ DV assaults granted bail

An Albany man accused of attacking his partner and threatening to slit her dog’s throat as she was trying to escape has been let out on bail. Jack Alexander Lusty appeared in custody in Albany Magistrates Court on Friday charged with aggravated assault and breaching a police order. The 35-year-old was represented by duty lawyer Graeme Payne who requested an adjournment and bail for his client. No pleas were entered to the charges. Mr Lusty is accused of grabbing his partner by the arm, throwing her to the ground and punching her in the face three times on December 7 before telling her she deserved it. On December 10, Mr Lusty allegedly called his partner a “disrespectful c...”, according to police prosecutor Sgt Warrick Walker, and then chased her through their home when she tried to leave the discussion. Mr Lusty allegedly grabbed a wooden ramp near the pool table and swung it towards the woman’s face, striking her toe when she tried to block it with her leg. Lusty allegedly then threw a glass bong and a cast iron object at her — the bong missed but the cast iron object allegedly struck the complainants legs. The woman grabbed one dog and tried to leave the address but Mr Lusty allegedly grabbed the other dog and threatened to slit its throat. The woman managed to get her other dog and took shelter at a neighbouring home to wait for emergency services to arrive. Mr Payne said his client would comply with protective conditions if granted bail, and said Mr Lusty has been struggling with severe back pain. My Payne said Mr Lusty had no history of violence and was not a flight risk. Sgt Walker opposed bail, describing the assault on December 7 as a “sustained assault” and stating Mr Lusty allegedly attempted to speak to the complainant on 25 occasions via text messaging and calling in a 20 minute window on December 11 and 12. Magistrate Erin O’Donnell described the allegations as “serious” and said the assault on December 10 appeared to be a “prolonged incident”. Ms O’Donnell took into account Mr Lusty’s lack of a violent history and flight risk, and granted bail with protective conditions for the complainant, a residential condition, to comply with directions from community corrections, and a $1000 personal undertaking. Mr Lusty will next appear in Albany Magistrates Court on January 16.
